Abstract

The legal analysis piece looks at Honduras' Supreme Court decision regarding the ZEDES, and explores the constitutional amendments that enabled them, highlighting their compliance with Honduras' established constitutional reform processes. Likewise, the article discusses how the ZEDEs autonomous governance structures operate within the bounds of the country's constitutionality. It argues that the innovative legal and fiscal systems introduced by ZEDEs promote economic growth and development while adhering to national sovereignty. In doing so, this legal examination rejects claims of the ZEDEs unconstitutionality, asserting that ZEDEs neither violate constitutional provisions nor diminish the nation’s sovereignty. Furthermore, the author criticizes attempts to retroactively criminalize ZEDE-related actions, stressing the importance of legal certainty and adherence to international human rights frameworks. The article concludes by advocating for an evaluation of ZEDEs based on their practical outcomes rather than ideological or unfounded legal challenges.
